INTENT TO DECLARE MINERAL INTEREST ABANDONED
Evansville Western Railway, Inc. is the current owner of the real property legally described as Exhibit
A;
A lien on said Properties exists by reason of an oil and gas lease dated March 3, 1964 and recorded April
1, 1964 in Volume 57, Page 709 and assigned in Volume 57, Page 111 and in Volume 59, Page 373 of the
Lease Records of Wood County, Ohio encumbering the real estate described in Exhibits A.
That, in connection with the above Lease:
a) No mineral interest is in coal, or in mining or other rights pertinent to
or exercisable in connection with an interest in coal; and
b) No mineral interest is held by the United States, the State of Ohio, or
any political subdivision, body politic, or agency of the United States or the State of Ohio.
That within the preceding twenty (20) years, in connection with the Lease:
c) No mineral interest has been the subject of a title transaction that has
been filed or recorded in the office of the Wood County recorder;
d) There has been no actual production or withdrawal of minerals by the
holder of a mineral interest from the Property, from the real estate covered by the Lease, or from the
real estate pooled, unitized, or included in unit operations in which said mineral interest is
participating;
e) No mineral interest has been used in underground gas storage operations
by the holder of a mineral interest;
f) No drilling or mining permit has been issued to the holder of a mineral
interest;
g) No claim to preserve a mineral interest has been filed;
h) No separately listed tax parcel number has been created for a mineral
interest in the Wood County auditor’s tax list or the Wood County treasurer’s duplicate tax list.
2. That pursuant to Section 5301.56 of the Ohio Revised Code, the Lease and
the leasehold interest created thereby is forfeited and terminated.

Exhibit A
Situated in Jackson Township, County of Wood, State of Ohio and being a part of the Southeast Quarter of
Section 25, Township 3 North, Range 9 East, a tract of land bounded and described as follows:
Beginning at the intersection of the north line of said quarter section with the west line of a Tract of
land described in Deed Volume 50, Page 19 in the Office of the Recorder of Wood County, Ohio, North 89
degrees 49 minutes 03 seconds West a distance of 296.94 feet from the northeast corner of said quarter
section;
Thence South 00 degrees 11 minutes 26 seconds West parallel with the east line of said quarter section a
distance of 52.44 feet, a point 60 feet southwesterly by perpendicular measure from the southerly right
of way of CSX Transportation Inc. (a 100’ right of way as now established);
Thence parallel with said southerly right of way North 81 degrees 37 minutes 18 seconds West a distance
of 367.68 feet to the aforesaid north line of said quarter section;
Thence along the north line of said quarter section South 89 degrees 49 minutes 03 seconds East a
distance of 363.93 feet to the point of beginning. Containing 0.219 acres of land, more or less, which
comes from parcel number G24-309-2500000 14000 with 0.179 acres lying in the road right-of-way, subject
to all legal highways and prior easements of record.

The Lake Township Trustees will hold a public meeting on July 21, 2009 at the Lake Township
Administration Building, 27975 Cummings Rd., Millbury, Ohio. Time of this meeting is 7:00 P.M.
The Lake Township Trustees will consider at this meeting the proposed amendment to the Lake Township
Zoning Resolution which has been requested by the application of Richard Ross, Owens Lake LLC.
The proposed amendment seeks to change the present zoning classification of “A-1” agricultural to “B-2”
general commercial on the property generally located in the SW 1/4, Section 7, Lake Township.
The current owner and address of property to be rezoned is: Owens Lake LLC, 29374 Tracy Road, Walbridge,
Ohio 43465, as it appears on the Wood County Auditor tax list.
The application proposing the amendment will be available for examination for a period of 10 days prior
to July 21, 2009 at the Lake Township Administration Building, 27975 Cummings Road, 8:30 A.M. – 4:30
P.M. Monday through Friday.
