A Bradner man accused of alleged rape has rejected a plea offer.

Michael Stultz II, 33, appeared Monday in the courtroom of Wood County Common Pleas Judge Molly Mack.

He was indicted in January for three counts rape, all first-degree felonies, and gross sexual imposition, a third-degree felony.

Wood County Chief Assistant Prosecutor Pamela Gross said the state offered a plea that included two counts of gross sexual imposition, one a third-degree felony and one a fourth-degree felony; and two counts of rape, both first-degree felonies.

There is a potential prison sentence of 28.5 years with these charges, she said.

“I will keep that offer open for a little while still,” she said.

Stultz had rejected a plea offer in May.

“We will not accept that offer today,” said defense attorney Scott Coon.

From March 22, 2020, to Sept. 30, Stultz allegedly had sexual contact with the same child who was 12 years old during the first alleged assault and was 14 years old at the time of the last alleged incident.

On Oct. 2 or Oct. 3, he alleged had sexual contact with a person who was 10 years old at the time of the offense.

A trial has been scheduled to start Oct. 3.
