Man accused of retaliating against victim is indicted in Wood County

A Toledo man in prison for kidnapping has been indicted for alleged retaliation.

A Wood County grand jury on Wednesday indicted James Willard McDowell III, 40, for two counts of retaliation, both third-degree felonies.

On May 17, he allegedly retaliated against a victim of a crime because the victim filed criminal charges.

McDowell also allegedly threatened harm to an attorney or witness who participated in the proceedings.

He was sentenced in April to six years in prison for kidnapping and is serving his time in the Trumbull Correctional Institution, Leavittsburg.

The grand jury also indicted:

• Zachery Alan Kiser, 41, Risingsun and currently in jail, for obstructing official business and vandalism, both fifth-degree felonies, and resisting arrest and operating a vehicle under the influence of alcohol, a drug of abuse or a combination of them, both first-degree misdemeanors. On July 1, sheriff’s deputies were dispatched to the area of Cygnet Road and U.S. 23 for a rollover crash. It was determined that Kiser was under the influence and an attempt was made to put him in handcuffs. He allegedly swung at one deputy with a closed fist then pulled away in an attempt to get away. The two deputies escorted Kiser to the ground, where he allegedly tried to pull at items on a duty belt. While in handcuffs, he allegedly attempted to reach into a front pocket to get a knife. One deputy stated his arm was hurt while Kiser resisted arrest. While at the hospital, Kiser was uncooperative with medical staff and a blood and urine sample was not obtained due to staff being concerned for their safety.

• Mickey Durfey, 55, Toledo, for breaking and entering, a fifth-degree felony. On Feb. 1, he allegedly trespassed into an unoccupied structure with the purpose of committing a theft offense. A warrant has been issued for his arrest.

• Joshua Evan Timko, 19, Haskins, for failure to comply with the order or signal of a police officer, a third-degree felony. On May 31, he allegedly fled from police after receiving a visible or audible signal to stop.

• Matthew Ryan Eidenour, 41, Sandusky, for possession of cocaine, a fifth-degree felony, and possession of drugs and operating a vehicle under the influence of alcohol, a drug of abuse or a combination of them, both first-degree misdemeanors. On July 7, he allegedly was found in possession of cocaine and Xylazine after being stopped for OVI.

• Jordan Cubia McCormick, 24, Marietta, Georgia, for counterfeiting, a fourth-degree felony, and possessing criminal tools, two counts receiving stolen property and aggravated possession of drugs, all fifth-degree felonies. On May 24, 2022, McCormick allegedly was found with a device with the intended use of counterfeiting and did allegedly commit fraud by using counterfeit currency. McCormick allegedly was in possession of two credit cards which were obtained through theft as well as oxycodone.

• Jim Alan Fields, 27, Toledo, for vandalism, a fifth-degree felony, and resisting arrest and obstructing official business, both second-degree misdemeanors. On June 24, police responded to the Rossford Recreation Center for two subjects who appeared to be breaking into the building. A man and woman, matching the description, were spotted in a nearby parking lot. The man allegedly provided a false name; the woman didn’t. Fields allegedly resisted arrest until he was Tased twice. He also allegedly spray painted the keyboard, card slot and display screen at a Fifth Third Bank ATM, causing it to not function.

• Cassandra Michelle James, 30, Toledo, for aggravated possession of drugs, a fifth-degree felony. On March 21, she allegedly was found in possession of oxycodone.

• Tyrice Stackhouse, 29, Columbus, for improperly discharging a firearm at or into a habitation or a school safety zone, a second-degree felony; and having weapons while under disability, a third-degree felony. On July 10-17, he allegedly discharged a firearm into an occupied structure and was in possession of a firearm after being convicted of felony drug possession in Ashtabula County in 2013. If found guilty, he may have to forfeit the Taurus C2c 9mm firearm he allegedly had in his possession. A warrant has been issued for his arrest.

• Matthew David Blumm, 44, Hendersonville, North Carolina, for two counts gross sexual imposition, both third-degree felonies. From Jan. 1-Feb. 29, 2016, he allegedly had sexual contact with the same minor who was 10 years old at the time.

• Ricky Lee Warthen, 34, Newport, Michigan, for failure to comply with the order or signal of a police officer, a third-degree felony; vehicular vandalism and safecracking, both fourth-degree felonies; and breaking and entering and possessing criminal tools, both fifth-degree felonies. On Jan. 11, he allegedly fled from police after receiving a visible or audible signal to stop and allegedly dropped or threw an object at or into the path of another vehicle. He also is accused of trespassing into an unoccupied structure to commit theft and tampering with a vault or safe. He had in his possession a dolly with the intent to use it criminally. A warrant has been issued for his arrest.

• Kendall Daray Shine, 30, Toledo, for theft, forgery and passing bad checks, all fifth-degree felonies. On Sept. 16, Shine allegedly transferred a check valued at $2,485 payable to another knowing payment would be stopped after allegedly forging the check from a Toledo-based semi-trailer dealer. A warrant has been issued for Shine’s arrest.
