A Dunbridge man charged with fatally striking a bicyclist in Bowling Green has been indicted for aggravated vehicular homicide.
A Wood County grand jury on Wednesday indicted James Patrick Lindsay, 54, with aggravated vehicular homicide, a first-degree felony; operating a vehicle while under the influence, an unclassified misdemeanor; and two counts attempted failure to stop after an accident, one a third-degree felony and one a fourth-degree felony.
Officers responded to the crash on South Main and Pearl streets on July 1 at 2:11 p.m.
According to the Bowling Green Police Division report, it was determined that the truck driven by Lindsay left the roadway and struck a pedestrian on a bicycle who was on the sidewalk. Michael Szabo, 60, Bowling Green, was pronounced dead at the scene.
Lindsay was transported to the Wood County jail, where he remains with a $250,000 bond.
Two witnesses told police that they saw Lindsay strike the bicyclist and then put the truck in reverse and try to leave the scene, according to the police report.
The F3 charge is for Lindsay allegedly not immediately stopping his vehicle and remaining at the scene when he knew the accident had resulted in the death of a person.
The F4 charge has the same wording except that the accident resulted in a death.
According to the indictment, Lindsay had previously been found guilty of OVI in Wood County, in 2014 and 2016.
Lindsay’s wife told officers that he had just been cited for operating a motor vehicle while under the influence and open container in a motor vehicle in June in Clyde, according to the police report.
A warrant for Lindsay’s blood was obtained after he showed signs of intoxication.
It may take several weeks to get those results, according to BGPD Lt. Adam Skaff.
An open container of alcohol was also in his truck, the police report said, and Lindsay had a suspended license.
The Ohio State Highway Patrol assisted at the scene. The Bowling Green Fire Division and Wood County coroner also responded.
A witness at the scene was arrested after it was found that he had three outstanding warrants.
Zachary Hayes, 33, Tiffin, was transported by the Wood County Sheriff’s Office to Findlay.
