Perrysburg man facing pandering charges declared incompetent

A Perrysburg man accused of multiple counts of pandering has been deemed incompetent.

Dustan Gershutz, 35, was transported from the jail Thursday to the courtroom of Wood County Common Pleas Judge Joel Kuhlman.

The court will follow the recommendations of the competency report, which states Gershutz is currently unable to assist in his own offense but is likely to become competent with in-house treatment.

A competency hearing was set for Nov. 9.

Gershutz and his roommate, Raymond F. Carter, 34, were indicted in March for 11 counts of pandering sexually-oriented matter involving a minor or impaired person, all second-degree felonies; pandering obscenity involving a minor or impaired person, a fourth-degree felony; and possessing criminal tools, a fifth-degree felony.

Eleven times from June 19, 2021, to Dec. 12, they allegedly created, recorded, reproduced or published material that showed a minor participating or engaging in sexual activity.

On Feb. 2, they are accused of buying, procuring or controlling obscene material that had a minor as one of its participants.

All electronic equipment and electronic storage devices were removed from their home. Circumstances indicate the devices were used in the alleged offenses.

Carter entered pleas of not guilty to the charges and a final pretrial has been scheduled for Aug. 3.
