Fostoria man pleads guilty to sexual battery

A Fostoria man has pleaded guilty to sexual battery and must register as a sex offender.

Mark Boos, 56, appeared Thursday in the courtroom of Wood County Common Pleas Judge Joel Kuhlman.

Wood County Assistant Prosecuting Attorney Brian Boos said on Oct. 11, Mark Boos had drinks with the victim and others then went back to his house. The victim fell asleep on the couch. She said she woke up with her pants removed.

Mark Boos admitted the victim was asleep when he removed her pants and underwear and performed a sex act, Brian Boos said.

Mark Boos and Brian Boos are not related.

“The victim was unaware the act was being committed,” Brian Boos said.

The state will dismiss the charge of rape, he said.

Mark Boos will have to register as a Tier III sex offender, which will require him to register every 90 days for the rest of his life.

Kuhlman said he can impose a sentence of 12-60 months for the third-degree felony charge.

Sentencing was scheduled for June 1.
