Man jailed for having sex with 13-year-old

A North Baltimore man will spend five years in prison for sexual conduct with a 13-year-old
girl.David T. Powell, 25, changed his plea on Friday morning and was found guilty of unlawful sexual
conduct with a minor.Powell appeared before Judge Alan Mayberry. Through a negotiated plea agreement,
the charge was amended to a third-degree felony, which was dropped from the original second-degree
felony charge. The agreement stipulated the prosecution drop a specification regarding his March 2011
conviction for a similar crime in Wood County Common Pleas Court.Heather Baker, an assistant Wood County
prosecuting attorney, told Mayberry that had the case gone to trial, the necessary witnesses would have
testified that Powell had sexual relations with the teen last April 5 resulting in her pregnancy. Though
she did not carry the baby to term, paternity tests determined that Powell was the father.In addition to
pleading to the new charge, Powell admitted a community control violation of his prior case.When given
the chance to address the court, Powell apologized, saying that he had put himself into a bad
situation."I really want to put myself on a better path and get myself home to see my kids and my
family."Through a stipulated agreement, the judge followed the recommended five-year maximum prison
sentence for the crime. The judge also ordered 18 months in prison on the probation violation and
ordered the sentences to be served concurrently.Mayberry also ordered a mandatory five-year post-release
control sanction and read Powell his requirements to register as a Tier II sexual offender. That level
requires in-person registration with the sheriff’s office where he resides, works or goes to school for
25 years.
