Perrysburg man sentenced for sexual battery of minor

A Perrysburg man will spend more than 14 years in custody for his sexual offenses
involving a young girl as well as illegal use of a minor in nudity-oriented
material.
Kevin Scott, 50, was ordered by Wood County Common Pleas Court Judge Robert Pollex to
spend three years in prison for each of four counts of sexual battery for his
sexual molestation of a young girl under the age of 13. In addition he was
ordered to nine months each on the two counts of illegal use of a minor and one
count of possession of criminal tools. All the sentences are to be served
consecutively for an aggregate total of 14 years and three months.
The defendant pleaded guilty to all charges in January.
The four sexual battery counts involve different time periods over the course of
several years dating back to 2003. The charges were part of a plea agreement
after he originally was charged with rape of the child.
Bill Hayes, one of Scott’s defense attorneys asked for an eight-year sentence, citing
no other criminal history and living as a "model citizen" in
Perrysburg for his entire life. Friends and family of the defendant wrote
letters to the court on his behalf.
Though acknowledging the devastating nature of the crimes to the victim, calling it a
"tragic, horrible case," Hayes portrayed his client as a "good
man and a good member of the community."
In trying to mitigate the sentence, Hayes also noted diagnosis of bi-polar
characteristics for his client as well as having obsessive and anxiety problems.

When allowed to speak on his own behalf, Scott thanked the court.
Because of his familiarity with the victim Scott admitted, "I broke a serious
bond."
He added, "It’s been on my mind for years and driving me insane. I am so glad
it’s out, so I can now get help."
He also expressed the hope the victim could get the help she needs in dealing with
his actions.
A member of the victim’s family addressed what his actions have done to the girl who
is now approaching adulthood.
The speaker said the damage to the victim is "so deep" she will not
graduate with her class. She also noted the damage caused to the victim’s
brothers.
"He has damaged three beautiful children," she said, then focused on the
victim. "He has stolen her innocence, her education and her future. What he
has taken is irreplaceable."
She added, "No punishment is sufficient for what he did to her."
Heather Baker, an assistant Wood County prosecutor, challenged the sincerity of
Scott’s remorse.
"He knew what he was doing was wrong. He’s not sorry for what he did, he’s sorry
he got caught," Baker told the court.
Baker asked the judge to order nearly 21 years in prison for his crimes.
She used Scott’s words that it was driving him insane for years against him, noting
he never came forward until the victim did when she was older years after the
assault. She also said reminded the judge that the pornographic images of minors
on his computer were very recent, years after the molestation had stopped.
Baker summarized, "He can never be rehabilitated."
Scott was also classified as both a Tier III sexual offender on the sexual assault
charges, and a Tier I sexual offender for the other charges. As such he is
required to register where he works and lives for the rest of his life.
The judge, called the case a "terrible tragedy," noting how Scott
"betrayed the trust" of the victim.
