BEITORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN,COUNTY OFWOOD,AND STATE OF OHIO:SECTION1: That the
Municipal Administrator ishereby authorized to executethe Preliminary Legislation with the OhioDepartment
ofTransportation (ODOT) in order to participate in ODOT’sproject thatwill upgrade traffic signals by adding
back-plates,battery backupsUPS, and LED street name signs to signalizedintersection on StateRoute 64
& State Route 25 at Newton Road inthe City of BowlingGreen, in accordance with the attached
agreement.SECTION2: This ordnance shall take effect as an emergency measure.Thereason for the emergency is
that the prompt effectiveness of thislegislation is necessary in order to meet deadlines set forth
byOhioDepartment of Transportation for participation in this project,therebyprotecting the public health,

CODIFIEDORDINANCES OF THE CITY OF BOWLING GREEN, OHIO, CONCERNING
ZONINGBOARDOF APPEALS AUTHORITY TO GRANT VARIANCES
FOR DRIVEWAYS BEITORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN,COUNTY OFWOOD,AND
STATE OF OHIO:SECTION1: That Section 150.132(E)(5) of theCodified Ordinances of the Cityof Bowling Green,
Ohio is herebyamended and adopted to read
asfollows:SECTION150.132 POWERS OF THE BOARD.
(E)Appeals to the Board.(5)The Board may grant a variance of§150.55(F) in any zoningdistrict. However, since
the dust associatedfrom unpaved surfacesis a public health nuisance incompatible with anyR, S, I, or
BDistrict, a variance can only be granted in anM-District if, inaddition to division (1) and (2) above, that
all thefollowingconditions are met:(a)Theproperty is no closer than1,000 feet to any R or S-1 or
S-5District;(b)Thefacts inevidence support that the parking, loading, or storage areawill not besubject to
average traffic greater than one vehicle perhour:(c)Becauseof the nature of the items parked, stored, or
loaded, thatanasphalt surface would not withstand the weight of the items orvehicles or that the minimum
depth of the concrete would have toexceedsix inches because of the weight of the vehicles being loadedor
usedto move the stored items;(d)Anagreement for annual dust control,as approved by the city engineerand

AN EMERGENCY BEIT ORDAINED BY THE COUNCIL OF THECITY OF BOWLING GREEN,COUNTY OFWOOD, AND
STATE OF OHIO:SECTION1: That Section 33.09(F) of the Codified Ordinances of the City ofBowling Green, Ohio,
is hereby amended and adopted to read asfollows:SECTION33.09 FIRE
DIVISION COMPOSITION (F)Underthe authority of R.C. §124.42,the Civil Service Commission shall
havethe right to certify for anoriginal appointment for any personotherwise qualified between theages of 18
and 41 years and the Mayoris authorized to appoint sucha person as in accordance with Charter§7.01.SECTION2:
All other existing portions of Section 33.09remain unchanged.SECTION3: This ordinance shall take effective
asan emergency measure. Thereason for the emergency is that it isnecessary to bring the City’sCode of
Ordinances into align with theOhio Revised Code, therebyprotecting the public peace, safety andwell-being of

the emergency is that itis urgently necessary to makethe needed street cut repairs prior tothe end of the
