Name and address of facility: Green Dairy, LLC; 11607 Bloomdale Road; Wayne, Ohio 43466.
Public notice is hereby given that the Ohio Department of Agriculture on May 29, 2009, issued Green
Dairy, LLC a final Modified Permit to Install and a final Modified Permit to Operate.
Green Dairy’s original Permit to Install included two 935-cow free stall dairy barns, one 330 dry cow
dairy barn attached to the milking parlor, one concrete settling basin, an earthen silage/storm water
pond and three-stage earthen manure storage ponds that would provide 358 days of storage. The Modified
Permit to Install will expand and reorient the three-stage earthen manure storage ponds, adding room for
manure treatment and an additional 49 days of storage. This addition still complies with all the
setbacks identified in the original final permits. The permitted number of animals is not changed by the
Permit Modification.
The Green Dairy, LLC final Modified Permit to Operate will add the use of manure treatment to its Manure
Management Plan which would assist in the reduction of odor and provide for a lower nutrient liquid.
This will enable application of the lower nutrient liquid over a growing crop, leaving a smaller volume
of high nutrient liquids and separated solids to be applied between spring and planting, and harvest and
winter. The final Modified Permit to Operate contains updated manure analysis and soil samples,
resulting in some of the acreage being removed from the permit. Under state law, the addition of a
manure containment structure which is capable of storing 10% or more of the previously permitted volume
requires the farm owner(s) to obtain a Permit Modification from the Ohio Department of Agriculture. When
a permit is modified, only the conditions subject to modification are reopened.
The final Modified Permit to Install and final Modified Permit to Operate can be appealed within 30 days
to the Environmental Review Appeals Commission (ERAC), 309 South Fourth Street, Room 222, Columbus, Ohio
43215. The appeal period ends at 5 p.m. on July 2, 2009. A copy of the appeal must be served on the
Director of Agriculture within three days after filing the appeal with ERAC.
