Custar Shooting Suspect to Receive Another Competency Hearing Tuesday

A Custar man previously deemed incompetent to stand trial for a November shooting in the village is
scheduled to be in court Tuesday for another competency hearing.
Thomas Boyer, 53, will appear in the courtroom of Judge Reeve Kelsey.
During a hearing in court last month, Kelsey noted that a report from an evaluator at the Court
Diagnostic and Treatment Center, Toledo, indicated Boyer was incompetent to proceed further with the
case.
Prosecuting Attorney Gwen Howe-Gebers asked for a second opinion based on particular issues in the
report.
"The state is dissatisfied," she said at the time.
Kelsey referred Boyer to Twin Valley Behavioral Healthcare, Columbus, for a further evaluation, which
could have taken up to 30 days.
Boyer is charged with one count of attempted murder and one count of felonious assault after the Nov. 20
shooting of William Morris, 42, Rutland, at Boyer’s former residence on Defiance Pike.
Morris, a subcontractor ultimately employed by One West Bank, had come to Boyer’s foreclosed residence to
determine if it was occupied, and to change the locks and winterize the home if it was not. The home was
scheduled to be sold at a Sheriff’s sale.
Boyer reportedly shot Morris once in the back with a shotgun when Morris was returning to his vehicle
after a confrontation. Morris survived the incident.
The shooting took place just across the street from St. Louis Catholic School, which was briefly placed
on lockdown as a precaution.
