ORDINANCE NO. 8643 Passed Dec. 28,

ORDINANCE AMENDING AND ADOPTING SECTION 33.37 OF THE CODIFIED
ORDINANCES OF THE CITY OF BOWLING GREEN, OHIO, REGARDING COMPENSATORY TIME FOR HOURLY
EMPLOYEES
 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND
STATE OF OHIO: SECTION 1: That Section 33.37 of the Codified Ordinances of the City of Bowling Green,
Ohio, is hereby amended and adopted to read as follows: Section 33.37 COMPENSATORY TIME
FOR HOURLY EMPLOYEES
 (A) Any employee not covered by a collective bargaining agreement
and who is not excluded from overtime pay by § 33.18
may receive compensatory time off in lieu of receiving overtime pay in
accordance with the provisions established within this section. (B) If any employee elects to take
compensatory time off in lieu of overtime pay for any overtime worked, the employee must make an
application for the compensatory time off on the applicable forms and process the application through
the immediate supervisor no late than the end of the payroll period in which the overtime is worked. If
the appropriate department/ division head concurs in granting the compensatory time, he or she shall
approve the form and submit it to the Finance Department for payroll
processing.
 (C) No employee may accumulate more than 80 hours of unused compensatory time
credit at any one time. (D) Approval authority for the granting of compensatory time off in lieu of
overtime pay rests with each department/division head. Any request for compensatory time in which the
request is for more time than the employee has accumulated but not used, or in which the 80-hour
accumulation limit has been reached, will not be approved. (E) Compensatory time shall be granted at the
rate of one and one-half hours for each hour of overtime compensation earned. Employees whose employment
is terminated for any cause are entitled to compensation for any accumulated but unused compensatory
time. The rate of compensation for each compensatory time hour in the situation shall be of the greater
of: the average regular rate for the last three years of employment; or the regular rate earned at the
time of termination. (F)Pursuant to Federal Law (29 CFR 553.27), upon termination of
employment, an employee shall be paid for unused compensatory time earned after April 14, 1986 at the
rate of compensation not less than-

  1. The average regular rate received by such employee during the last 3
    years of the employee’s employment, or
  2. The final
    regular rate received by such employee, whichever is higher.

(G) Compensatory time shall only be granted for overtime work which is required and has been previously
approved by the appropriate supervisor. (H) The Finance Director shall
determine the appropriate entries to be made upon payroll records for recording compensatory time. (I)
Hourly (non-exempt) employees who are promoted into salaried (exempt) classification within the city
shall be paid for their unused compensatory time that they had earned/banked as an hourly (non-exempt)
employee. The payment for the unused compensatory leave shall be accomplished through the payroll
process as soon as possible following promotion into a salaried (exempt) classification. Compensatory
leave shall be paid to the employee through the payroll system at the rate of pay the employee held as
an hourly (non-exempt) employee immediately prior to promotion to the salaried (exempt) classification.
Following promotion into a salaried (exempt) classification an employee shall no longer be eligible to
use or earn compensatory time. SECTION 2: This ordinance shall take effect at the earliest time

ORDINANCE AMENDING AND ADOPTING SECTION 114.11 OF THE CODIFIED
ORDINANCES OF THE CITY OF BOWLING GREEN, OHIO, REGARDING TAXICAB DRIVER’S LICENSE ISSUANCE, DURATION AND
FEE
 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE
OF OHIO: SECTION 1: That Section 114.11 of the Codified Ordinances of the City of Bowling Green, Ohio,
is hereby amended and adopted to read as follows: SECTION 114.11 DRIVER’S LICENSE
ISSUANCE, DURATION, AND FEE
 Upon approval of the application for a taxicab or public
transit driver’s license, the Taxicab License Board shall issue a license to the applicant which shall
bear the name, age, height, weight, signature, and photograph of the applicant and signature of Taxicab
License Board authority. The license shall be in effect for the remainder of the calendar year. A
license for every calendar year thereafter shall be issued upon the payment of the applicable fee as set
forth by Section 35.70, unless the license for the preceding year has been revoked. No license shall be
issued until ten days after the application has been filed, or after completion of the investigation of
the applicant, whichever comes first. SECTION 2: This ordinance shall take effect at the earliest time

BOWLING GREEN COMMUNITY DEVELOPMENT FOUNDATION, INC., IN LIEU OF DUES, AND DECLARING AN
EMERGENCY
 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND
STATE OF OHIO: SECTION 1: That the approximately 3.15 acres of real estate located in Bellard Business
Center, Plat 1, more fully described on the exhibit attached hereto and made a part hereof, is
authorized to be deeded to the Bowling Green Community Development Foundation, Inc., in order to promote
an economic development activity, in lieu of dues. SECTION 2: This ordinance shall take effect as an
emergency measure. The reason for the emergency is the prompt effectiveness of this measure is necessary
in order to facilitate the development of an office building on the site, generating more jobs for the
community. The project is on a strict time line requiring prompt the effectiveness of this measure,

RESOLUTION ADOPTING AMENDMENTS TO THE POLICY & PROCEDURES
MANUAL FOR B.G. TRANSIT
 WHEREAS, the City of Bowling Green receives state and federal
funding annually from the Ohio Department of Transportation (ODOT) to provide public transportation to
citizens; and WHEREAS, a Policy & Procedures Manual is required for transit systems funded by
the Ohio Department of Transportation; and WHEREAS, the adoption of proposed amendments to the Policy
& Procedures Manual was recommended by the Transit Advisory Committee at the November 21, 2017
meeting. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO: SECTION 1:
Following consideration of the recommendation for adoption made by the Transit Advisory Committee, the
Council does hereby approve the proposed amendments to the Policy & Procedures Manual for B.G.
Transit. SECTION 2: The Policy & Procedures Manual is required by the Ohio Department of
Transportation. SECTION 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this resolution were adopted in an open meeting of the
Council, and that all deliberations of this Council and any of its committees that resulted in such
formal actions were in meetings open to the public in compliance with all legal requirements. SECTION 4:

RESOLUTION ADOPTING AND AUTHORIZING AN AMENDED HOUSING REVOLVING LOAN
FUND PROGRAM POLICY & PROCEDURES MANUAL
 WHEREAS, the City of Bowling Green has
entered into a Housing Revolving Loan Fund (RLF) Administration Agreement with the State of Ohio,
Development Services Agency, which authorizes the City to provide housing assistance to city residents
using the Housing RLF; and WHEREAS, the State of Ohio, Development Services Agency (formerly the Ohio
Department of Development, OHCP) has reviewed and approved the City’s Housing Policy &
Procedures Manual and authorized the City to make changes where needed; and WHEREAS, the aforementioned
Agreement requires the City to have a locally-adopted Housing RLF Policy & Procedures Manual;
and WHEREAS, amendments to the existing Housing RLF Policy & Procedures Manual to reflect
various mandated changes and to better clarify existing procedures; and NOW THEREFORE, BE IT RESOLVED BY
THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO: SECTION 1: Following the necessity for an amended,
adopted manual, the Council of the City of Bowling Green does hereby approve the proposed Housing RLF
Policy & Procedures Manual for use by the City of Bowling Green. SECTION 2: It is hereby found
and determined that all formal actions of this Council concerning and relating to the passage of this
resolution were adopted in an open meeting of the Council, and that all deliberations of this Council

provide (in part) housing assistance to city residents; and WHEREAS, a copy of said amended manual has
been provided to the CDBG funding source, the U.S. Department of Housing and Urban Development, Columbus
Field Office and met with positive response; and NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF BOWLING GREEN, OHIO: SECTION 1: Given that said manual assists staff in delivering quality
compliant programming to local residents, the Council of the City of Bowling Green does hereby approve
the proposed amendments to the CDBG Housing Policy & Procedures Manual by the City of Bowling
Green. SECTION 2: It is hereby found and determined that all formal actions of this Council concerning
and relating to the passage of this resolution were adopted in an open meeting of the Council, and that
all deliberations of this Council and any of its committees that resulted in such formal actions were in
