Barbara Muir, a former accountant for Belmont Country Club in Perrysburg township will spend 60 days in jail for her theft conviction regarding funds siphoned from her former employer.
Wood County Common Pleas Court Judge Reeve Kelsey handed down the sentence Monday afternoon.
Muir, 65, of Maumee, pleaded guilty to the charge on Nov. 30.
As charged, Muir was accused of spending more than $51,000 on a credit card for personal expenses beyond the authorized intent of the country club.
The offenses were documented to have occurred between Jan. 1, 2002 and Aug. 30, 2008.
Prior to sentencing, Muir’s attorney Jerome Phillips told the judge he had been in negotiations with Belmont’s attorney regarding possible use of annuity payments due to Muir from her retirement to handle the restitution which Kelsey ordered to be in the amount of more than $54,173.
Kelsey also ordered Muir to perform 300 hours of community service, at the rate of not less than 100 hours per year. He also placed her on five years of community control sanctions.
The judge also informed the defendant he is reserving the right to sentence her to 18 months in prison, should she fail to follow the guidelines of the probation department in regards to her community control.
Kelsey noted the “serious economic harm” caused the country club due to her actions as an employee.
Doug Crocker, the treasurer for Belmont Country Club was allowed to address the judge before Muir was sentenced.
Crocker confirmed the existence of a $150,000 annuity that was due to Muir at her retirement. However, he indicated country club officials believe Muir may have destroyed records while she was employed.
Gary Kovach, a former manager at the club also was indicted for the theft of more than $69,000. That case is still pending. Muir, as part of her plea agreement, is to be available to testify should it be necessary in the Kovach case.
Crocker told the judge exact figures on Belmont’s losses could not be determined but estimated in the combined cases, the amount could exceed $500,000.
Heather Baker, an assistant Wood County prosecuting attorney, told Kelsey, despite the treasurer’s figure, the restitution amount named was all they could document based on figures available and the statute of limitations.
When Muir was provided the chance to speak before the judge issued his sentence, she gave a tearful apology and stated she hoped the one day the people at Belmont would forgive her.
“I am deeply and profoundly sorry for the wrong I’ve done,” Muir said.
“I lost my way. I allowed anger and resentment to cloud my judgement. “I humbly ask for the court’s mercy today,” she said.
When Kelsey told her she would spend time in jail, she grabbed her face and audibly sobbed. The judge granted her request for a stay until March 1 to report to the Wood County jail.

This country has seen a lot of trouble lately with funds being taken by those who did not have a right to them, but the judge's sentence for Mrs. Muir seems a bit extreme to me. I wonder what Gary Kovach will receive?

Belmont is on the verge of bankruptcy. Not only due to the action of the past employee's who embezzled but also due to the current board who seems to be blind to the situation. They either have no clue as to what is happening or find it easier to look the other way. Why they hired an over priced useless club manager seems to be based on the the good old boys network. I see them closing within the year.
