COLUMBUS, Ohio (AP) — The Republican leader of the Ohio House says the law makes clear the state's auditor cannot audit the private funds of a state nonprofit, and he calls the GOP auditor "confused" and "erratic."

House Speaker William Batchelder told reporters Tuesday that action from the General Assembly wasn't necessary to keep the auditor from gaining access to the financial records of JobsOhio.

Auditor Dave Yost issued a subpoena on March 6 to review the funds of the job creation nonprofit. Yost argues Ohio law gives him the right to review private financial records with ties to public funds.

Batchelder suggested the state could seek its answers regarding the auditor's authority in court. He said Yost's subpoena compromises the nonprofit's economic development duties.

Batchelder said he's "totally blown away by this."
