A Weston man will spend 30 days in jail following a plea to an assault charge Tuesday.
Adolfo Lopez, 27, Weston, appeared before Wood County Court of Common Please Judge Robert Pollex.
Lopez had initially been charged with a felony count of gross sexual imposition after a July 22, 2012, incident in which he reportedly entered the Weston Marathon in an inebriated state and approached a female employee with the intent of kissing her. She pushed him back, and he reportedly then pushed her into a corner out of view from a store camera.
"He continually assaulted her while attempting to obtain a kiss from her," said prosecuting attorney Gwen Howe-Gebers.
Lopez's attorney, Esteban Callejas, who translated the words of the judge into Spanish for his client, said that Lopez has learned "he doesn't have a right to invade anyone's space or person without permission to do so."
As part of a plea agreement, the original sexual imposition charge was changed to a first-degree misdemeanor count of assault. Lopez was sentenced to 180 days in the Wood County jail, but 150 of those days were suspended, as was a $500 find.
Lopez must complete an evaluation for a sex offender treatment program, and a substance abuse treatment evaluation, and will be on probation for two years. He does not have to register as a sex offender.
