A Custar man previously deemed incompetent to stand trial for a November shooting in the village is
scheduled for another competency hearing this afternoon.
Thomas Boyer, 53, will appear in the courtroom of Judge Reeve Kelsey.
During a hearing last month, Kelsey made note of a report from an evaluator at the Court Diagnostic and
Treatment Center, Toledo, indicating Boyer was incompetent to proceed further with the case.
Prosecuting Attorney Gwen Howe-Gebers asked for a second opinion based on particular issues in the
report.
"The state is dissatisfied," she said at the time.
Kelsey subsequently referred Boyer to Twin Valley Behavioral Healthcare, Columbus, for a further
evaluation.
Boyer is charged with one count of attempted murder and one count of felonious assault after the Nov. 20,
2013, shooting of William Morris, 42, Rutland, at Boyer’s former residence on Defiance Pike.
Morris, a subcontractor ultimately employed by One West Bank, had come to Boyer’s foreclosed residence to
determine if it was occupied, and to change the locks and winterize the home if it was not. The home was
scheduled to be sold at a Sheriff’s sale.
Boyer reportedly shot Morris once in the back with a shotgun when Morris was returning to his vehicle
after a confrontation. Morris survived the incident.
