Martinez given 7 days in jail for gross sexual imposition PDF Print E-mail

Daniel Jesus Martinez, 22, of Adrian, Mich., was sentenced Monday morning for his conviction of gross sexual imposition.
Martinez previously had accepted a plea agreement reducing his charge from unlawful sexual conduct with a minor. The indictment indicated his offense involved a 13-year-old female last July.
Wood County Common Pleas Court Judge Reeve Kelsey ordered Martinez to serve seven days in the Wood County jail and three years on community control sanctions.
Defense attorney Salvatore C. "Sam" Molaro Jr., admitted that his client "exhibited poor judgment."
Molaro also said Martinez "should have seen the difficulties in his actions before he did."
When given the opportunity to speak on his own behalf, the defendant declined, simply stating, "no, your honor."
However Molaro said this case "has had a big impact on him."
Both the defense and prosecution recommended community control sanctions. However, the prosecution also requested he be required to undergo a sexual offender evaluation and treatment.
The judge concurred.
In issuing the sentence, Kelsey noted how the severity of the crime was exacerbated by the victim's age.
In addition to the short-term jail sentence, the judge warned Martinez that he is reserving 18 months in prison for failure to follow the community control sanctions set forth.
In addition to the sexual offender evaluation and any treatment ordered, he must also provide 300 hours of community service, pay a $1,000 fine and have no conduct with the victim.
Martinez must also register as a Tier I sexual offender.
