Indiana woman indicted for allowing teen to be raped PDF Print E-mail

A former area woman has been indicted with endangering children, a third-degree felony, by a Wood County grand jury.
Tanya Garcia, 41, formerly of Wood County and now a resident of Washington, Ind., was charged with the felony at the Feb. 20 grand jury session. According to the indictment, from July 1 to Dec. 7 last year, she placed a female teen in danger by creating "a substantial risk to the health and safety" to the victim by "violating a duty of care, protection or support."
According to the indictment the victim suffered "serious physical harm."
In a related case, Eduardo Garcia-Cruz, 24, is being held in the Wood County jail on $100,000 bond on three counts of rape and three accompanying counts of sexual battery involving the same teen victim who was under age 16 at the time of the first alleged incident.
Garcia-Cruz appeared before Judge Robert Pollex on Tuesday and through his attorney Jane S. Randall indicated he has reached a plea agreement in the case.
He is expected to return to court Tuesday to plead guilty to two of the sexual battery charges, with the prosecution set to drop the remaining charges at sentencing.
Randall stressed to the judge, that had it not been for the plea agreement she would have proceeded with a motion to suppress some of the evidence in the case and proceed to trial.
At Tuesday's appearance, the jury trial date set to begin on Wednesday was vacated. Garcia-Cruz used an interpreter for the proceedings.
According to the announced agreement, both sides will be free to recommend an appropriate sentence at his next appearance after the defense has time to translate and review all the plea documents for the defendant.
