BG zoning board denies duplex request PDF Print E-mail

Bowling Green's Zoning Board of Appeals Wednesday night denied a request to grant a variance to allow a house in the 100 block of Troup Avenue to again be used as a duplex.
All six members of the board in attendance opposed the change.
The property, owned by David Jackson, had been used as a duplex as a non-conforming use.
Planning Director Heather Sayler told the ZBA that in its review of non-conforming use properties the city found that the use of the property as a duplex had been discontinued for more than a year, in which case the non-conforming status had been lost. She said Jackson wanted the property to be used as duplex.
Jackson said he had owned the property since 1992 and purchased it as an income property. For many years he had lived in the home and had rented out the upstairs and at times the basement. Jackson now lives elsewhere in BG. He said that of 18 other houses on Troup, only two are owner-occupied. Jackson said the lot sizes are all non-conforming and that many of the houses are of similar design.
ZBA member Rose Hess pointed out that three other cases have come up in recent years on Troup Street with two being granted temporary variances and the third being denied with an order to reduce the number of occupants immediately.
Jackson has the option of appealing the denial to the Wood Common Pleas Court.
The ZBA also:
•    Deferred to the BG Planning Commission a request to allow  a driveway that would not be a hard dustless surface for its entire length at 229 Berkley Drive. ZBA Chairperson Robert Waddell said he had concerns that the group had jurisdiction because the city zoning code only allows a variance to the rule in the M zoning class, which covers industrial property. He suggested the matter go to the commission, which could choose to amend the code, with the approval of city council.
•    Approved by 6-0 votes variances for the number of signs at both Thayer Honda, 1255 N. Main St., and Thayer Chevrolet, 1225 N. Main St. The Honda building is new and the Chevrolet building is being expanded. A total of seven signs will be allowed at Honda and five signs at Chevrolet.
