Appeals court reverses drug offence sentencing

The Ohio Sixth Circuit Court of Appeals reversed a judgment in a 2011 Wood County drug
case.Terrance J. Brown, 27, Detroit, had previously pleaded no contest and been sentenced to a mandatory
three years in prison after 30 mg. of oxycodone were reportedly found during a traffic stop on
Interstate 280.The stop, for a marked lanes violation, was made by a Lake Township officer.The court, in
an decision filed Friday, agreed with the defense argument that evidence from the stop should have been
excluded because the stop was unreasonable.The court noted that, while the incident did not violate
Brown’s Fourth Amendment rights, under the Ohio Constitution the stop was unreasonable because the
officer was outside of their jurisdiction when the stop was made, and that "no extenuating
circumstances were present to justify an extraterritorial stop by township officers for this type of
traffic violation."The case was remanded for further proceedings consistent with the decision.
