Andrew Z’s conviction is upheld

TOLEDO – The Ohio Sixth Circuit Court of Appeals has upheld a lower court ruling against area radio
personality Andrea Z concerning his conviction after violating the court’s ban on frequenting
establishments which served alcohol.
The judgment against Andrew Z, 45, Maumee, whose real name is Andrew Zepeda, was filed Friday.
Zepeda was indicted on theft and failure to file and remit sales tax charges in 2010 related to incidents
at a failed pizzeria he operated at Levis Commons, and received intervention in lieu of conviction from
Wood County Court of Common Pleas.
As part of the conditions of that ruling, he was not to frequent establishments which served alcohol.
However, in 2011 and 2012, Zepeda was reported to be in violation of that condition, and the intervention
was dropped. He was subsequently convicted and sentenced to five years of community control and payment
of a restitution balance of $20,000.
Zepeda appealed, arguing the court’s requirements were "unduly burdensome and punitive," given,
among other factors, the duties and nature of his work. He further argued that the court abused its
discretion in finding him in violation, saying "the use of the word ‘frequent’ in the alcohol
establishment condition implies that (Zepeda) would be in violation only if he appeared multiple times
at a banned location."
