SEALED BIDS for the furnishing of the necessary materials and construction of the

will be received by the City of Bowling Green, Ohio at the office of the Municipal Administrator, in the City Administrative Services Building, 304 North Church Street, until
10:00 AM EASTERN DAYLIGHT TIME
TUESDAY
JUNE 8, 2010
and at that time and place will be publicly opened and read aloud.
The proposed work consists of the following: Removing Pavement, Base, Curb, Sidewalk, Drives, Curb Ramps, Catch Basins, Installing Aggregate Base, Asphalt Concrete, Concrete Curbs, Sidewalk, Drives, ADA Curb Ramps, Pavement Markings, Seeding, Mulching, Topsoil. Installing Cured in Place Pipe, Sanitary Laterals and Abandon Sewer. Installing Electric and Communication Conduit, Wiring, and Street Lighting.
The contract documents, including drawings and specifications, are on file at the office of the City Engineer, City Administrative Services Building, 304 North Church Street, Bowling Green, Ohio. A set may be obtained by depositing $50.00. Checks shall be made payable to the City of Bowling Green, Ohio.
The full amount of the deposit for the first set of documents obtained will be refunded to each bona fide bidder or vendor who returns the completed documents in good condition within ten (10) days after the opening of bids. The full amount of the deposit will be returned to each non-bidder who returns the documents in good condition prior to the bidding date.
Additional copies (in excess of one) of the Contract Documents may be purchased at $50.00 each. No refund will be allowed for the return of the said additional copies.
Should a bidder prefer to receive the bid documents via UPS or FedEx, arrangements must be made by that bidder to arrange for all necessary items such as, but not limited to mailers, envelopes, etc. to be delivered to the City of Bowling Green with all pertinent mailing information. Otherwise, all bid packets will be mailed by USPS.
All bids shall be signed and submitted on the blanks which are bound in the specifications. Bid blanks shall not be removed from the specifications. Bids shall state the unit prices on the blanks provided therefor; shall be enclosed in a sealed envelope marked -- WOO-64-1.85 EAST WOOSTER STREET --- and addressed to the Municipal Administrator, City Administrative Services Building, 304 North Church Street, City of Bowling Green, Ohio 43402. Each bid must contain the name of every interested person, firm or corporation and be accompanied by a bid guaranty to the City of Bowling Green as described in the contract documents.
The bid guaranty may be of two forms:
1. A Bid Guaranty and Contract Bond in the amount of 100% of the bid using the forms provided in the specifications. (The amount of the bid does NOT have to appear on this form.)
2. A certified check, cashier’s check or letter of credit in favor of the City of Bowling Green in the amount of 10% of the bid. If the contract is awarded, a Contract Bond will be required, which is a 100% payment and performance bond.
Bids received after the scheduled bid opening date and time, or not accompanied by a satisfactory bid guaranty, will neither be read nor considered.
The Successful Bidder and any and all Sub-Contractors must comply with the provisions of the Ohio Revised Code, Chapter 4115, and will be required to enter into a separate Public Improvement Agreement with the OWNER prior to the execution of the Contract Documents. A sample copy of said Public Improvement is included in the Appendix.
The Successful Bidder will not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, disability or age. The Successful Bidder will take affirmative action to ensure that applicants for employment are considered for employment and that employees treated during employment, without regard to their race, religion, color, sex, national origin, disability or age. The Successful Bidder will also incorporate the requirements of this paragraph in all of its respective contracts for subcontracted work. Further, he/she agrees that they and any subcontractor shall comply with Ohio Administrative Code 5501-1-02, Appendix B, State Equal Employment Opportunity Covenant.
The City of Bowling Green, Ohio reserves the right to reject any and all bids and to waive any irregularity in any bid and to determine the lowest and best bidder.
No bidder may withdraw his bid for a period of 60 days after the scheduled closing time for the receipt of bids. The City of Bowling Green reserves the right to award only the base bid items or base bid items along with the alternate bid items listed in this Invitation to Bid.

NOTICE TO BIDDERS
Sealed bids will be received by the Village Administrator, 25 North Second Street, Village of Waterville, Ohio 43566 until 2:00 p.m. (local time) on June 10, 2010 for the furnishing of all labor, materials, tools, equipment, and appurtenances necessary for the construction of the 2010 Paving Program and at that time be publicly opened and read aloud.
The project consists of removal and replacement of 739 square yards of failed concrete pavement located on Cedar Lane Maple Court, and associated work.
The Contract Documents including the construction plans, proposal form and specifications, are on file at the office of Proudfoot Associates, 5360 Heatherdowns Blvd., Toledo, Ohio 43614, and may be obtained during normal business hours upon non-refundable payment of $100.00. The Contract Documents will also be on file in the Builders Exchange of Toledo, 5555 Airport Highway, Suite 140, Toledo, OH 43615.
Bids for the said project must be signed and enclosed in a sealed envelope addressed to the Administrator of the Village of Waterville and marked 2010 Paving Program. Each bid must be accompanied by a bid bond, certified check, or bank cashiers check payable to the Village in the amount of ten (10%) of the bid as a guarantee that if the work is awarded to the bidder, he will, within fifteen (15) days of the date of such award enter into a proper and acceptable contract, otherwise, said amount accompanying his bid will be forfeited to the Village of Waterville, Ohio, as liquidation damages.
Bids received after the scheduled Bid opening date and time, or not accompanied by a satisfactory Bid Bond or check, will neither be read nor considered.
Bidders must comply with the Prevailing Wage Rates on Public Improvements in Lucas County, as determined by the Ohio Bureau of Employment Services, Wage and Hour Division, (614) 644-2239.
Bidders shall submit with their Bid the affidavit required under Ohio Revised Code Section 5719.042 that the bidder was not charged with any delinquent personal property taxes in Lucas County, Ohio. (Contract Page AC-1)
The successful bidder will be required to submit a Performance Bond, Maintenance Bond, Certificates of Insurance, and complete Homeland Security DMA Form and ORC Section 3517.13 Affidavit.
The Village of Waterville reserves the right to reject any or all bids, to waive any irregularities in any bid, and to accept any bid which is deemed to be the most favorable to the Village. The Village also reserves the right to add or subtract from the quantities shown in the proposal.

PUBLIC NOTICE
The following applications and/or verified complaints were received, and the following draft, proposed, or final actions were issued, by the Ohio Environmental Protection Agency (OEPA) last week. “Actions” include the adoption, modification, or repeal of orders (other than emergency orders); the issuance, denial, modification or revocation of licenses, permits, leases, variances, or certificates; and the approval or disapproval of plans and specifications. “Draft Actions” are written statements of the Director of Environmental Protection’s (Director’s) intent with respect to the issuance, denial, etc. of a permit, license, order, etc. Interested persons may submit written comments or request a public meeting regarding draft actions. Comments or public meeting requests must be submitted within 30 days of notice of the draft action. “Proposed Actions” are written statements of the Director’s intent with respect to the issuance, denial, modification, revocation, or renewal of a permit, license, or variance. Written comments and requests for a public meeting regarding a proposed action may be submitted within 30 days of notice of the proposed action. An adjudication hearing may be held on a proposed action if a hearing request or objection is received by the OEPA within 30 days of issuance of the proposed action. Written comments, requests for public meetings, and adjudication hearing requests must be sent to: Hearing Clerk, Ohio Environmental Protection Agency, P.O. Box 1049, Columbus, Ohio 43216-1049 (Telephone: 614-644-2129). “Final actions: are actions of the Director which are effective upon issuance or a stated effective date. Pursuant to Ohio Revised Code Section 3745.04, a final action may be appealed to the Environmental Review Appeals Commission (ERAC) by a person who was a party to a proceeding before the Director by filing an appeal within 30 days of notice of the final action. Pursuant to Ohio Revised Code Section 3745.07, a final action issuing, denying, modifying, revoking, or renewing a permit, license, or variance which is not preceded by a proposed action, may be appealed to the ERAC by filing an appeal within 30 days of issuance of the final action. ERAC appeals accompanied by a $70.00 filing fee which the Commission in its discretion may reduce if by affidavit the appellant demonstrates that payment of the full amount of the fee would cause extreme hardship must be filed with: Environmental Review Appeals Commission 309 South Fourth Street, Room 222, Columbus, Ohio 43215. A copy of the appeal must be served on the Director within 3 days after filing the appeal with the ERAC.
