At all times material herein, Amherst Village Management Company LLC was the landlord and Defendant Janetta M. Loyd was the tenant with respect to the aforementioned real property. As a result of the Defendant Janetta M. Loyd's negligence, Plaintiff insured sustained damage in the amount of $110,011.87. Plaintiff State Farm Fire & Casualty Company was required to and did pay to its insured the sum of $105,011.87, and became subrogated to said amount. Plaintiff Amherst Village Management Company LLC sustained a $5,000.00 deductible loss. Count II: Plaintiffs reiterate and reallege paragraphs I through 5 as if fully rewritten herein. Defendant Janetta M. Loyd failed to refrain Defendant Robert R. Shannon from negligently damaging the leased premises, therefore, breaching her duty as a tenant imposed by Ohio Revised Code §5321.05(A)(6). Count III: Plaintiffs reiterate and reallege paragraphs 1 through 7 as if fully rewritten herein. On or about June 27, 2011, at 1520 Clough Street in Bowling Green, Ohio, the Defendant Robert R. Shannon negligently caused a fire at Plaintiff insured's real property. Wherefore, Plaintiffs demand judgment against the Defendants, jointly and/or severally, in the amount of $110,011.87, plus the costs of this action.
