ORDINANCE NO. 8270 Passed OCT. 21, 2013 ORDINANCE AUTHORIZING THE MUNICIPAL ADMINISTRATOR TO EXECUTE THE OHIO DEPARTMENT OF TRANSPORTATION'S (ODOT) PRELIMINARY LEGISLATION TO PARTICIPATE IN THE ODOT PROJECT TO UPGRADE TRAFFIC SIGNALS BY ADDING BACK-PLATES, BATTERY BACKUPS AND LED STREET NAME SIGNS TO SIGNALIZED INTERSECTIONS ON STATE ROUTE 64 & STATE ROUTE 25 AT NEWTON ROAD IN THE CITY OF BOWLING GREEN, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the Municipal Administrator is hereby authorized to execute the Preliminary Legislation with the Ohio Department of Transportation (ODOT) in order to participate in ODOT's project that will upgrade traffic signals by adding back-plates, battery backups UPS, and LED street name signs to signalized intersection on State Route 64 & State Route 25 at Newton Road in the City of Bowling Green, in accordance with the attached agreement. SECTION 2: This ordnance shall take effect as an emergency measure. The reason for the emergency is that the prompt effectiveness of this legislation is necessary in order to meet deadlines set forth by Ohio Department of Transportation for participation in this project, thereby protecting the public health, safety and well-being of our citizens. ORDINANCE NO. 8271 Passed OCT. 21, 2013 ORDINANCE AUTHORIZING THE UTILITIES DIRECTOR TO ADVERTISE FOR BIDS AND ENTER INTO A CONTRACT OR CONTRACTS FOR BUTTONWOOD AVENUE SEWER IMPROVEMENTS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the Utilities Director is hereby authorized to advertise for bids and enter into a contract or contracts for Buttonwood Avenue sewer improvements. ORDINANCE NO. 8272 Passed OCT. 21, 2013 ORDINANCE AUTHORIZING THE UTILITIES DIRECTOR TO SEEK QUALIFICATIONS AND ENTER INTO A CONTRACT OR CONTRACTS FOR ENGINEERING SERVICES FOR THE GRIT REMOVAL SYSTEM IMPROVEMENTS AT THE WATER POLLUTION CONTROL FACILITY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the Utilities Director is hereby authorized to seek qualifications for and enter into a contract or contracts for engineering services for the grit removal system improvements at the Water Pollution Control Facility. ORDINANCE NO. 8273 as amended 10/21/13 Passed OCT. 21, 2013 ORDINANCE APPROVING THE S-DISTRICT SITE PLAN FOR A GARAGE AT FALCON'S POINTE, LOCATED AT 912 KLOTZ ROAD, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the S-District Site Plan for the garage additions to be built at Falcon's Pointe, generally located at 912 Klotz Road, more fully identified on the exhibits attached hereto and made a part hereof is hereby approved. SECTION 2: This ordinance shall take effect as an emergency measure. The reason for the emergency is that the property owner would like to proceed with construction during the present construction season, thereby protecting the public peace and well-being of the citizens. ORDINANCE NO. 8274 Passed OCT. 21, 2013 ORDINANCE AMENDING AND ADOPTING SECTION 150.132(E)(5) OF THE CODIFIED ORDINANCES OF THE CITY OF BOWLING GREEN, OHIO, CONCERNING ZONING BOARD OF APPEALS AUTHORITY TO GRANT VARIANCES FOR DRIVEWAYS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That Section 150.132(E)(5) of the Codified Ordinances of the City of Bowling Green, Ohio is hereby amended and adopted to read as follows: SECTION 150.132 POWERS OF THE BOARD. (E) Appeals to the Board. (5) The Board may grant a variance of §150.55(F) in any zoning district. However, since the dust associated from unpaved surfaces is a public health nuisance incompatible with any R, S, I, or B District, a variance can only be granted in an M-District if, in addition to division (1) and (2) above, that all the following conditions are met: (a)The property is no closer than 1,000 feet to any R or S-1 or S-5 District; (b)The facts in evidence support that the parking, loading, or storage area will not be subject to average traffic greater than one vehicle per hour: (c)Because of the nature of the items parked, stored, or loaded, that an asphalt surface would not withstand the weight of the items or vehicles or that the minimum depth of the concrete would have to exceed six inches because of the weight of the vehicles being loaded or used to move the stored items; (d)An agreement for annual dust control, as approved by the city engineer and annual inspection by a project inspector, has been recorded with the deed to the property. SECTION 2: All other portions of Section 150.132 remain unchanged. SECTION 3: This ordinance shall take effect at the earliest time permitted by law. ORDINANCE NO. 8288 Passed OCT. 21, 2013 ORDINANCE AMENDING AND ADOPTING SECTION 33.09 (F) OF THE CODIFIED ORDINANCES OF THE CITY OF BOWLING GREEN, OHIO REGARDING FIRE DIVISION COMPOSITION, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That Section 33.09(F) of the Codified Ordinances of the City of Bowling Green, Ohio, is hereby amended and adopted to read as follows: SECTION 33.09 FIRE DIVISION COMPOSITION (F) Under the authority of R.C. §124.42, the Civil Service Commission shall have the right to certify for an original appointment for any person otherwise qualified between the ages of 18 and 41 years and the Mayor is authorized to appoint such a person as in accordance with Charter §7.01. SECTION 2: All other existing portions of Section 33.09 remain unchanged. SECTION 3: This ordinance shall take effective as an emergency measure. The reason for the emergency is that it is necessary to bring the City's Code of Ordinances into align with the Ohio Revised Code, thereby protecting the public peace, safety and well-being of our citizens. ORDINANCE NO. 8290 Passed OCT. 21, 2013 ORDINANCE AUTHORIZING THE MUNICIPAL ADMINISTRATOR TO ENTER INTO A CONTRACT OR CONTRACTS WITH RUTTER & DUDLEY FOR STREET CUT REPAIRS, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the Municipal Administrator is hereby authorized to enter into a contract or contracts with Rutter & Dudley for street cut repairs in the City of Bowling Green. SECTION 2: This ordinance shall take effect as an emergency measure. The reason for the emergency is that it is urgently necessary to make the needed street cut repairs prior to the end of the current paving season, thereby protecting the public safety, health and well-being of our citizens.
