ORDINANCE NO. 8265 Passed Sept. 16, 2013 ORDINANCE CREATING AND ADOPTING SECTION 100.05 OF THE CODIFIED ORDINANCES OF THE CITY OF BOWLING GREEN, OHIO, PROHIBITING DRILLING FOR OIL, GAS, OR OTHER MINERALS, NOT INCLUDING WATER, BY HYDRAULIC FRACTURING, AKA FRACKING, OR THE USE OF SIMILAR WATER PRESSURED TECHNOLOGY, AND PROHIBITING DEEP WELL STORAGE OF WASTE BRINE FROM FRACKING OPERATIONS, AND DECLARING AN EMERGENCY NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That Section 100.05 of the Codified Ordinances of the City of Bowling Green, Ohio is hereby created and adopted to read as follows: SECTION 100.05 HYDRAULIC FRACTURING AKA FRACKING A. No person shall, within the corporate boundaries of the City of Bowling Green, use the drilling technique known as hydraulic fracturing, sometimes known as fracking, or use a similar water pressured technology, when drilling for oil, natural gas, or other minerals, with the exception of drilling for fresh water or ground water. B. No person shall, within the corporate boundaries of the City of Bowling Green, store in wells or other outdoor locations brine or liquid waste generated by fracking operations. C. Any person who violates the provisions of this section shall be guilty of a misdemeanor of the first degree, with each day constituting a separate offense. SECTION 2: This ordinance shall take effect as an emergency measure. The reason for the emergency is the prompt effectiveness of this measure is necessary in order to preserve and protect the stability of the underground utilities which constitute the City's utility system, including, but not limited to, water, sewer, and electric, and thereby protect the public health, safety an well-being of our citizens. ORDINANCE NO. 8275 Passed Sept. 16, 2013 ORDINANCE AUTHORIZING THE PURCHASE OF APPROXIMATELY TWENTY (20) ACRES OF LAND GENERALLY LOCATED ON HASKINS ROAD AND ON NEWTON ROAD FROM ROBERT W. MAURER, TRUSTEE, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO, COUNTY OF WOOD, AND STATE OF OHIO: SECTION 1: That the Mayor of the City of Bowling Green, Ohio, is hereby authorized to enter into a contract or contracts with Robert W. Maurer, Trustee, for the purchase of approximately 20 acres of land generally located on Haskins Road and on Newton Road in the City of Bowling Green in substantial accordance with the exhibit attached hereto and made a part hereof, and to take all actions necessary in order to complete said purchase and restore the site for future public use and purposes as determined from time to time. SECTION 2: This ordinance shall take effect as an emergency measure. The reason for the emergency is that the prompt effectiveness of this measure is necessary in order to acquire the site and to begin seeding, grooming and preparing the site for the upcoming soccer season, thereby protecting the public health, safety and especially the well-being of our citizens. RESOLUTION NO. 3547 Passed Sept. 16, 2013 RESOLUTION AUTHORIZING THE CITY ATTORNEY TO PETITION THE BOARD OF COUNTY COMMISSIONERS OF WOOD COUNTY, OHIO, TO CHANGE TOWNSHIP LINES BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, STATE OF OHIO: SECTION 1: That the City Attorney is hereby authorized to petition the Board of County Commissioners of Wood County, Ohio, to change township lines for Bowling Green and Center Township and for Plain Township in order to conform the township lines with the limits of the City of Bowling Green corporation, and so as to incorporate all annexations that may have taken place since the creation of “Bowling Green Township” in accordance with Section 503.07 of the Ohio Revised Code.
