Marsh, City Attorney June 25, '12 RESOLUTION NO. 3507 Passed June 18, 2012 RESOLUTION OPPOSING THE CENTRAL COLLECTION OF MUNICIPAL INCOME TAXES BY THE STATE OF OHIO WHEREAS, the municipal income tax is the largest source of General fund revenue for the City of Bowling Green and for most municipalities in Ohio; and, WHEREAS, any disruption or interference with the current collection process will be harmful to financial operations and will impair Bowling Green's ability to provide essential governmental services such as police and fire protection, emergency medical assistance, public works and capital projects, as well as desirable and beneficial services such as recreation programs and maintenance of parks; and, WHEREAS, the City of Bowling Green has a good and efficient method for tax collection with a collection cost of only 2.1%; and, WHEREAS, only municipalities can and will provide the personal service and assistance to its taxpayers in the preparation and filing of their tax returns; and, WHEREAS, the centralized collection of municipal income tax by the Ohio Department of Taxation would eliminate local service to taxpayers and contradict the principles of local control and accountability and the right to Home Rule as defined in the Ohio Constitution; and WHEREAS, municipalities have supported the development and growth of business activity with the resources provided by a local income tax based on employment location, any potential change in this basis of collections could have a detrimental effect on future revenue for the City of Bowling Green; and BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO: SECTION 1: That the Council of the City of Bowling Green, Ohio does hereby declare its strong opposition to any effort by the State of Ohio to require centralized collection of Ohio Municipal income taxes. SECTION 2: That the Council of the City of Bowling Green, Ohio, opposes any effort by the State of Ohio to remove local administration of income tax collection. SECTION 3: That the Clerk of Council is authorized and directed to send a certified copy of this Resolution to local representatives and appropriate officials as determined by the Tax Commissioner.
