ORDINANCE NO. 8295 Passed Jan. 21, 2014 ORDINANCE ACCEPTING ANNEXATION OF APPROXIMATELY 2.409 ACRES OF LAND IN PLAIN TOWNSHIP, WOOD COUNTY, OHIO FROM DAVID A. KNAUSS, ET AL, PETITIONERS WHEREAS, a petition for annexation of certain territory in Plain Township was duly filed by the owners thereof, and WHEREAS, the petition was duly considered by the Board of County Commissions of Wood County, and WHEREAS, the Board of County Commissioners has approved the annexation to the City of Bowling Green; and WHEREAS, the Board of County Commissioners certified the transcript of proceedings in connection with the annexation with a map and petition required in connection therewith to the Clerk of City Council, who received the same on the 30th day of October, 2013; and WHEREAS, 60 days from the date of the filing have now elapsed in accordance with the provisions of Ohio Revised Code Section 709.04 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, WOOD COUNTY, OHIO: SECTION 1: That the proposed annexation as applied for in the petition by David A. Knauss, George A. Knauss, Richard Knauss, Sr. and Barbara Loose of the real estate in the territory sought to be annexed and filed with the Board of County Commissions of Wood County, which petition sought annexation to the City of Bowling Green of certain territory adjacent thereto and as fully described on the exhibits attached, was approved for annexation to the City of the Board of County Commissioners, and the same is hereby accepted. SECTION 2: That the Clerk of Council is hereby authorized and directed to make three (3) copies of this ordinance, to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners, and a certificate as to the correctness thereof. The Clerk of Council shall then forthwith deliver one copy to the County Auditor, one copy to the County Recorder, and one copy to the Secretary of State, and shall file notice of this annexation with the Board of Elections within 60 days after it becomes effective, and the Clerk of Council shall do all other things required by law. INVITATION TO BID SEALED BIDS for the furnishing of the necessary materials and construction of the SOUTH STREET STORM SEWER IMPROVEMENTS WAYNE, OHIO will be received by the Village of Wayne, Ohio at the office of the Village Administrator, 125Schoolhouse Street, Wayne, Ohio 43466 until 10:30 a.m. (Local Time) Tuesday, February 11, 2014 and at that time and place will be publicly opened and read aloud. The scope of work consists of installing approximately 670 lineal feet of 12" storm sewer, catch basins, and appurtenances. The contract documents, including plans and specifications, are on file at the office of the Village of Wayne, Ohio and the Engineer -- Poggemeyer Design Group, Inc. (PDG). A non-refundable deposit in the amount of $50 will be required for each set of plans and specifications; check must be made payable to Becker Impressions. Bids must state the unit prices in the blanks provided and be enclosed in a sealed envelope marked --- SOUTH STREET STORM SEWER IMPROVEMENTS -- and addressed to the Village of Wayne, 125 Schoolhouse Street, Wayne, Ohio 43466. The bid guaranty may be of two forms: 1. A Bid Guaranty and Contract Bond using the form in the Contract Documents. (The amount of the bid does NOT have to appear on this form.) 2. A certified check, cashier's check or letter of credit in favor of the Village of Wayne, Ohio, in the amount of 10% of the bid. If the contract is awarded, a Contract Bond will be required, which is a 100% payment and performance bond. After the award of the contract let by competitive bid and prior to the time the contract is entered into, bidders shall submit the affidavit required under the Ohio Revised Code, Section 5719.042 that the bidder was not charged with any delinquent personal property taxes in Wood County, Ohio. The successful bidder will be required to pay not less than the minimum wage rates established by the Department of Industrial Relations of the State of Ohio. The Village of Wayne, Ohio reserves the right to reject any and all bids and to waive any irregularity in any bid and to determine the lowest and best bidder.
