The Village of Pemberville and the Wood County Prosecutor's Office have struck a deal with Marcella A. Abke regarding her theft in office charge. On Wednesday, the 50-year-old Abke accepted a plea agreement and pleaded guilty to a misdemeanor charge of theft before Judge Mark Reddin at Bowling Green Municipal Court. Abke was indicted last December for one count of theft in office, a fourth-degree felony offense. As part of the agreement and her plea, a motion has been filed by the prosecutor's office to dismiss the felony offense in Wood County Common Pleas Court. Abke, in her former role as Board of Public Affairs clerk for the Village of Pemberville, has admitted to taking cash utility payments and failing to deposit those payments into the village's accounts.
Paul Dobson, prosecutor for the county, revealed the agreement on Thursday. "The village primarily wanted to assure the funds lost were paid back," Dobson said of the motivation for the agreement. Following the acceptance of her plea, the judge proceeded directly to sentencing. Reddin ordered Abke to five years of community control sanctions, 180 days in jail and a $1,000 fine. Both the jail sentence and the fine were suspended, based on her fulfilling the court's sanctions including full payment of restitution. The restitution totals $14,738, of which $3,213 will be paid to Pemberville. Dobson said that was the actual loss of funds determined stolen by the defendant through the state auditor's office investigation. The remaining $11,525 will be to pay for the cost of that audit. The thefts were documented to have been committed between March 31, 2009, through Feb. 28, 2011.
