MILLBURY - A woman recently sentenced to prison had property she owns in Lake Township partially rezoned last week
At Tuesday's meeting, the Lake Township Trustees approved accepting the planning commission's recommendation that three lots remain neighborhood business and two lots be changed to residential.
Michelle Scaggs of Triple Star Home Improvement had requested that all five lots on property at 4425 Walbridge Road, Northwood, be rezoned from B-1 neighborhood business to B-3 highway business.
Scaggs, who was not at Tuesday's meeting, was sentenced earlier this month to 30 months in prison for defrauding the state workers' compensation system for several years.
Scaggs and Frederick Diebert, both of George Street in Northwood, were also ordered to pay more than $200,000 in restitution after failing to pay workers' compensation premiums for their employees and incorrectly classifying their employees as independent contractors. They were found guilty of the third-degree felony July 15.
The proposed amendment sought to change the present zoning classification of lots 3-7, Nobles Addition or the southwesterly corner of the intersection of Walbridge, Mathews and Woodville roads.
Solicitor Philip Dombey said the trustees should proceed with the zoning hearing, despite Scaggs' absence.
Jeff Pettit, who is running for Lake Township trustee in November, asked if Scaggs was convicted of the workers compensation fraud.
Dombey said comments should be limited to the agenda.
"I'm against it," Pettit said. "It puts a bad mark on Lake Township."
Bob Asmus asked if the taxes were current on the property.
Dombey said that wasn't relevant to the zoning application.
Other residents also spoke against the rezoning, at least for some of the lots, saying trucks would be allowed to drive through residential areas.
The main drawback, however, was the lack of a site plan submitted with the zoning request.
"We need to know exactly what they're doing with the lots," said Lake Township Trustee Richard Welling.
If the trustees had decided to change the planning commission's decision, a unanimous vote would have been needed.
The zoning change is effective in 30 days.
Scaggs can appeal to the Wood County Common Pleas Court.
